  5.     The on-again, off-again saga of the Noriega tapes turned on
  6. again last week. Federal District Judge William Hoeveler lifted
  7. the ban he had imposed a month ago on CNN's airing of General
  8. Manuel Noriega's government-monitored phone conversations from
  9. prison. Reason: counsel for the ex-Panamanian dictator no
  10. longer objected to having them broadcast. After reviewing
  11. transcripts of the five tapes obtained by CNN, lawyer Frank
  12. Rubino concluded that the most damaging conversation had
  13. already been played on the air and that it "does no good to
  14. close the barn door after the horse is out." Yet Rubino
  15. continued to insist that the drug-trafficking case against
  16. Noriega be dismissed altogether. Much of the government's phone
  17. tapping, he said, violates the confidentiality guaranteed to
  18. lawyer-client conversations.

  20.     CNN hailed the latest ruling as a vindication of its First
  21. Amendment rights and began to air more Noriega phone calls.
  22. These conversations suggested that the prisoner was making
  23. surreptitious banking transactions, a charge filed by the
  24. Panamanian government in another court proceeding last week.
  25. Meanwhile, four competing news organizations rushed before
  26. Judge Hoeveler to request the transcripts of the phone calls.
